Short description: On 16.01.2024, the European Court of Justice reached a landmark decision that supports the rights of refugee women. In order to be granted refugee status, membership of a particular social group must be established. “Women” were previously regarded as “too large a group” and “not delimitable”; the Court has now clarified that status as a social group cannot be denied in the context of gender-specific persecution.What are the requirements for refugee status? What does the ECJ ruling mean for asylum procedures in future? What advice is important in the context of asylum procedures and gender-based violence?
